Understanding the Affidavit of Marriage in Kenya

 

An Affidavit of Marriage is a vital document that serves as proof of a legally recognized marriage between two individuals. It is commonly required by government authorities like the National Health Insurance Fund (NHIF) , financial institutions,  immigration offices, and other entities like employers. The purpose of this document is to provide an official declaration of the couple’s union, ensuring legal recognition and rights for both parties.

To obtain an Affidavit of Marriage in Kenya, the following steps are involved:

 

  1. Both spouses must provide comprehensive information about their marriage, including the date of the marriage, location, and any supporting documentation that validates the marriage.
  2. The spouses are required to appear before a Commissioner for Oaths or a Notary Public to swear or affirm the contents of the affidavit. This step confirms the truthfulness and accuracy of the information provided.
  3. After the affidavit is prepared, both spouses will sign the document in the presence of the Commissioner for Oaths or Notary Public. The Commissioner or Notary Public will then notarize the affidavit by affixing their official stamp, thus validating its authenticity.
